<p> Victims of the 2005 bombings in a Turkish holiday resort will tonight appear on BBC One’s Real Story programme as part of their fight to push the government to compensate British citizens injured or killed by terrorist acts whilst abroad.  Mickey Aspinall and Toni Punshon are members of a family who were all seriously injured in the terrorist bombing in Turkey.  Like other British victims of terrorism abroad, they have received no compensation for their injuries.    </p>
<p>&#13;</p>
<p>The Criminal Injuries Compensation Scheme (CICS) does not compensate these victims and the government’s current review suggests this will not change.  The family are being represented by Jill Greenfield, personal injury solicitor (http://www.ffw.com/practiceareas/personalinjury/introduction.aspx ) at Field Fisher Waterhouse and alongside victims of the bombings in Egypt and Bali, have responded to the government’s review of CICS.  They are pushing to be included in the scheme and expect a response from the Government by the summer.</p>
<p>&#13;</p>
<p>The victims of the Turkish bombing were traveling in the minibus in which the bomb went off.  One member of the family was killed, the rest of the family (another five) have suffered serious injuries. One member of the family alone has suffered a fractured skull, serious leg injuries, damage to his eye, major bowel damage, a burst ear drum and a serious hand injury.</p>
<p>&#13;</p>
<p>He requires extensive surgery and treatment and it is unknown whether or not he will return to his work in a factory. The rest of the extended family have also suffered terrible injuries including one child who has suffered hearing damage and must now wait for several months before hearing aids will be made available.</p>
<p>&#13;</p>
<p>Despite the severity of their injuries, the family have been given no financial support from the government and they fall outside the Criminal Injuries Compensation Scheme. The family risk losing their home and bills are mounting up.</p>

These people were targets of terrorism by virtue of their British citizenship. It is wrong that the damages from this should be borne by the individual. The knowledge that there is no financial safety net for such victims serves the terrorist aims and adds to the general fear caused by terrorism.”</p>

<p> Using mediation to resolve medical malpractice lawsuits offers many benefits, but barriers put up by doctors, hospitals, and their lawyers often stand in the way of it being employed effectively, a study co-authored by Columbia Law School Professor Carol Liebman finds.</p>
<p>&#13;</p>
<p>The study found that when used, mediation could not only reduce the costs of litigation, and has the potential to offer closure to plaintiffs and ensure that procedures are changed in hospitals to prevent recurrences of the error that sparked the lawsuit. However, too often that potential goes unrealized.</p>
<p>&#13;</p>
<p>“Change will require medical leaders, hospital administrators, and malpractice insurers to temper their suspicion of the tort system sufficiently to approach medical errors and adverse events as learning opportunities, and to retain lawyers who embrace mediation as an opportunity to solve problems, show compassion, and improve care,” according to the study, published in the Journal of Health, Politics, Policy and Law.</p>
<p>&#13;</p>
<p>Liebman, an internationally recognized expert on mediation and negotiation, directs the Law School’s Mediation Clinic. Co-author Chris Stern Hyman was formerly an Adjunct Research Scholar at the Law School.</p>
<p>&#13;</p>
<p>Mediation is where an impartial third party helps both sides in a dispute negotiate a mutually acceptable resolution. The parties are not required to settle and can return to litigation. However, all mediation sessions are confidential and what is discussed is inadmissible if the dispute goes to court.</p>
<p>&#13;</p>
<p>The study looked at 31 cases from 11 nonprofit hospitals in New York City in 2006 and 2007 that went to mediation. About 70 percent of the cases settled either during or after mediation, resulting in monetary settlements from $  35,000 to $  1.7 million.</p>
<p>&#13;</p>
<p>On the surface, the case for mediation would appear to be compelling in medical malpractice cases because:&#13;<br />
</p>
<p>&#13;<br />
     The outcome is under the parties’ control.&#13;<br />
     Plaintiffs can receive payment soon after the harm instead of waiting years.&#13;<br />
     Defendants do not have to pay outside lawyers to try the case.&#13;<br />
     Members of the medical staff do not have to prepare for discovery and a trial.&#13;<br />
     Even if the mediation doesn’t resolve the case, it may create enough momentum to lead to a settlement.
<p>In spite of those benefits and the fact that many of the mediated cases settled, the study found “major challenges” remain for mediation to gain greater acceptance in malpractice suits.</p>
<p>&#13;</p>
<p>Most significantly, in none of the cases studied did a doctor take part in the mediation. The study authors view that as a missed opportunity, noting “it is possible that plaintiffs would have been even more satisfied with the process had their physicians demonstrated respect and caring” by attending the mediation.</p>
<p>&#13;</p>
<p>Defense lawyers often cited the doctors’ work schedules to explain their absence. Others did not want to subject the doctors to being verbally attacked by the plaintiff. This “deprives them and their patients of the opportunity for healing, understanding, forgiveness, and repair of broken relationships and failed communication,” the study concluded.</p>
<p>&#13;</p>
<p>The authors cited research that found patients expect an apology after a medical error, and that most doctors want to oblige, but they—and their lawyers&#8211;refrain from doing so out of fear of legal liability. However, the confidentiality of mediation would obviate that. </p>
<p>&#13;</p>
<p>“Anecdotes abound of injured patients and their family members who have continued to seek care from—and even recommended to their friends—hospitals that apologize for medical errors and adverse events,” according to the study.</p>
<p>&#13;</p>
<p>The absence of doctors in mediation also limits the ability, the authors write, for doctors and hospitals to learn from the medical errors and improve the quality of care.</p>
<p>&#13;</p>
<p>Liebman co-authored the study with Chris Stern Hyman of the Medical Mediation Group; Clyde B. Schechter of the Albert Einstein Medical Center; and William M. Sage of the University of Texas School of Law.</p>

Dussault and Zatir helped a client who was injured at work after tripping over an object on the floor.  At the time of the accident, the client was employed as a certified nursing assistant.  The client sustained a knee injury which ultimately required two (2) surgical interventions.  After surgery, the client sought physical therapy and unfortunately due to the client’s age and injury, did not obtain a full recovery. It was in the best interest of the client to resolve this case as the client was receiving social security benefits and was able to reinforce that income with the proceeds from the lump-sum settlement. </p>

<p> General Patent Corporation (GPC), a leading patent licensing and enforcement firm, announced today on behalf of its subsidiary, Leighton Technologies LLC, that it settled a lawsuit regarding Leighton&#8217;s six &#8220;Contactless Cards&#8221; patents.  AllSafe Technologies, Inc. of Amherst, N.Y., agreed to settle its lawsuit with Leighton Technologies and take a license for the Leighton patents. </p>

<p>The license with Allsafe Technologies came as the result of the settlement of a declaratory judgment lawsuit, Allsafe Technologies, Inc. v. Leighton Technologies LLC, U.S.D.C., Western District of NY (Buffalo), 1:10-cv-00077.  </p>

<p>&#8220;We are pleased that the lawsuit filed by AllSafe was amicably settled and that AllSafe agreed to license the Leighton patents,&#8221; said Paul J. Lerner, General Patent&#8217;s Sr. Vice President and General Counsel. </p>

<p><i>Answer by LunaSky</i><br/>It can take almost a year before a menstrual cycle can go &#8220;average&#8221; again. usually it takes a couple of months for it to come once a month 5-7 days. i still breast feed my 8 month older twins and i have my normal cycle but i have got word that for some woman, as abundant as they have milk then they have no cycle. it all depends on the woman</p>
