<p>Welfare is intended to be used by people while they try to get back on their feet so they and their families don&#8217;t starve, freeze and do without basic necessities.  It works for a lot of families.</p>

<p> TRAUB EGLIN LIEBERMAN STRAUS LLP (TELS) is pleased to report that, in a recent case argued by the firm before the Superior Court of New Jersey in Essex County, the firm won a precedent-setting decision regarding the enforceability of claims-made policies in New Jersey.</p>
<p>&#13;</p>
<p>An inspection company was sued for negligence arising from a home inspection performed in 1999. The inspection company sought coverage under its liability policy, but was denied coverage because the retroactive date of the policy was the same date that the policy began (meaning there was no retroactive coverage for prior acts).</p>
<p>&#13;</p>
<p>After being denied coverage, the inspection company subsequently filed suit against the insurance company, claiming that the lack of a retroactive &#8220;lookback&#8221; period was illegal and violated New Jersey&#8217;s public policy.</p>
<p>&#13;</p>
<p>TELS attorneys Jonathan Reed and Aileen Droughton represented the insurer in the case, arguing that the insured (the inspection company) had been offered the choice of an extended &#8220;lookback&#8221; period in plain, easy-to-read language. However, the inspection company refused the extended coverage for economic reasons. All of the applications and renewal forms made clear reference to the retroactive date. And they also pointed to the home inspector&#8217;s written request that said, in effect, that the inspector did not wish to pay an additional premium for coverage for acts occurring before the beginning of the policy.</p>
<p>&#13;</p>
<p>In a clear victory for companies issuing claims-made policies, the Court agreed with TELS&#8217; arguments, ruling that the insurance company&#8217;s New Jersey Notice of Election of Retroactive Coverage Form was clear and &#8220;straightforward.&#8221; The Court opined that, when faced with a choice between the two policies, the insured knowingly opted not to purchase retroactive coverage prior to the date of inception.</p>
<p>&#13;</p>
<p>The case involved was Caine, et al. v. Dorval, et al. and R.K.M. Inspection Services, Inc. v. Evanston Insurance Company, et al. (New Jersey Superior Court, Law Division, Essex County, docket number ESX-L-9485-02)</p>

<p> Rumors about gun confiscations.  Angry protests about the government’s tax policies, replete with Nazi comparisons.  A resurgent militia movement.  Rage at the election of a president deemed to be illegitimate and threatening.  Distrust and anger toward the government fueled by paranoia and conspiracy theories.</p>
<p>&#13;</p>
<p>They are among the crosscurrents of anger and hostility that have swept certain sectors of the country since President Barack Obama took office nearly a year ago.  And they are contributing to “a toxic atmosphere of rage in America,” according to the Anti-Defamation League (ADL), which today issued a report looking at the various sources that have given rise to a climate of anti-government fervor in the United States.</p>
<p>&#13;</p>
<p>“Rage Grows in America: Anti-Government Conspiracies” examines the groups and individuals behind this upsurge in anti-government anxiety, from the “birthers” who claim the president is not an actual citizen of the U.S., to militia groups fearful that the government plans to forcibly disarm American citizens, to those who suggest that the health-care reform movement is akin to the Nazi policies that led to the Holocaust.</p>
<p>&#13;</p>
<p>“In the year since we marked the historic election of the nation’s first African-American president we have seen a tremendous amount of anger and hostility,” said Abraham H. Foxman, ADL National Director.  “There is a toxic atmosphere of rage in America being witnessed at many levels, and it raises fundamental questions for our society.</p>
<p>&#13;</p>
<p>“While not all of America has bought into these conspiracies, they seem to be seeping more and more into the mainstream,” added Mr. Foxman.  “And since many of these expressions are interconnected in some significant ways, we wanted to try and connect the dots and ask the basic questions of why the anger, why now, and where might it lead.”</p>
<p>&#13;</p>
<p>From the anti-government “Tea Parties,” where protestors have made explicit Nazi comparisons or suggested that the president is subverting the Constitution, to anger-filled town hall meeting disruptions over health care, the wave of anti-government animus has manifested itself in many forms, according to ADL.  It has played out across a spectrum of groups, from mainstream groups and politicians to more extreme organizations and individuals.</p>
<p>&#13;</p>
<p>“The fact that these anti-government sentiments are coming from such a broad spectrum makes it more likely that some individuals will become so inflamed with anger that they will move farther toward the fringes,” said Robert G. Sugarman, ADL National Chair.  “This could result not only in the swelling of the ranks of anti-government extremist groups and movements, but might give rise to more individuals who are willing to act on their anger.”</p>
<p>&#13;</p>
<p>The ADL report looks at various sources of anti-government anger, including:&#13;<br />

     Conspiracy Theories: One of the most disturbing trends in the rise of anti-government sentiment has been the resurrection and proliferation of conspiracy theories alleging dark, violent designs on the part of the federal government to “declare martial law” and end democratic government, to confiscate firearms from American citizens and to build hundreds of concentration camps to house “dissidents.”  These theories have spread far and wide on social-networking sites.&#13;<br />
     The Resurgence of the Militia Movement: The rise of anti-government sentiment has paralleled a resurgence of the militia movement, an anti-government extremist movement that has a long history of criminal activity and violence.  Within the past two years, the movement has almost quadrupled in size, growing to more than 200 groups in the United States.  It is the most receptive audience for the extreme anti-government conspiracy theories and their radicalizing potential.&#13;<br />
     Town Hall Meeting Disruptions:  In the summer of 2009 a variety of anti-government protests and disruptions occurred at town hall meetings organized by senators and representatives across the country to discuss health-care reform.  These events became a fertile ground for anti-Obama protests and stunts, with some individuals angrily launching verbal attacks against the president and other office holders.  Some protestors compared the administration and its proposed health care reform policies to those of Nazi Germany.&#13;<br />
     Government Resisters:  Since Obama’s election, an increasing number of people have urged that he and his administration must “be resisted.” Some groups have implicitly or explicitly urged armed resistance.  Many of these groups have appropriated an idealized version of Revolutionary War history for their own purposes.  ADL’s report looks at the activities of several resistor groups, including The Oath Keepers and The Three Percenters.&#13;<br />
     The Tea Parties:  At these events and later sequels organized by conservative groups and grassroots activists, anti-government sentiments and conspiracy theories proliferated, with a common theme being that Obama had “stolen” the country from Americans.&#13;<br />
     Media Influence:  Some segments of the mainstream media have played a surprisingly active role in generating anti-government sentiment.  Though a number of media figures and commentators have taken part, the media personality who has played the most active role has been radio and television host Glenn Beck, who along with many of his guests have made a habit of demonizing the Obama administration and promoting conspiracy theories about it.&#13;<br />

<p> MorganFranklin Corporation, a business and technology solutions provider to government and business leaders on high-stakes financial, operations, and IT issues, announced the findings of an informative new research study assessing the state of governance, risk, and compliance (GRC) efforts in the federal government. Conducted by the Association of Government Accountants (AGA), &#8220;The Maturity of GRC in the Public Sector: Where Are We Today? Where Are We Going?&#8221; was sponsored by MorganFranklin as part of the AGA&#8217;s Corporate Partner Advisory Group (CPAG) Research Series. The study reveals that a number of challenges and obstacles are preventing widespread adoption of GRC in federal agencies.</p>
<p>&#13;</p>
<p>The report is the product of interviews with federal stakeholders, as well as survey responses from AGA members and federal CFOs, CIOs, and risk officers. Researchers found that the primary challenge agencies face is a lack of agreement on the meaning of the term GRC and the purpose of GRC programs. The respondents provided a wide variety of definitions for GRC, and as a result, 70% indicated that they faced challenges obtaining “buy-in” from senior management.</p>
<p>&#13;</p>
<p>&#8220;While there are many complex issues to address regarding federal agencies&#8217; GRC efforts, more than 94% of respondents indicated support for and willingness to do more with GRC efforts,&#8221; said Bill Hughes, managing director of MorganFranklin&#8217;s Federal Advisory Services practice. &#8220;The survey results indicate that federal agencies recognize GRC as a means to improve business processes, eliminate duplication, and reduce the cost of compliance while advancing their overall missions in an era of shrinking budgets.&#8221;</p>
<p>&#13;</p>
<p>The report also indicates that there is much work to be done with respect to GRC efforts in the federal government. Some key findings include the following:&#13;<br />

<p>   Agencies believe that GRC can have a real impact on their performance, with 63% of respondents agreeing that investing in GRC can drive accountability and performance.&#13;<br />
   At the time of the survey, the majority of agencies had not implemented GRC models. In fact, 81% of respondents noted that their organizations had yet to develop unified, integrated approaches to GRC.&#13;<br />
   Agencies that had already begun developing GRC programs realized benefits in other areas of compliance, with several using GRC to address American Recovery and Reinvestment Act (ARRA) transparency requirements and comply with Open Government initiatives.
<p>&#8220;MorganFranklin strongly supports the recommendations in the report, including developing and creating a fully integrated GRC approach,&#8221; Hughes said. &#8220;This exciting research comes at a pivotal moment as federal agencies navigate dynamic challenges while continually being asked to do more with less. In order to fully leverage all of the benefits of a GRC initiative, the federal community must collectively demonstrate strong leadership in this area and gain consensus and collaboration to unlock the organizational and operational value that can be achieved through GRC programs and initiatives.&#8221;</p>
